Terms of Service

1. Agreement to These Terms

By accessing or using Hamia's products at hamia.io or any connected Hamia subdomain, you agree to be bound by these Terms of Service. If you do not agree, please do not use our products.

These terms apply to everyone who uses Hamia: visitors, business owners and their staff, developers building on the Hamia API, and the customers a business serves through a connected channel.

2. What Hamia Provides

Hamia is a global technology company building AI-powered products for businesses, creators, and developers, including Hamia Agent, Hamia Studio, Hamia Manager, Hamia API, and Hamia Pay. Hamia provides the technology that powers these products, it does not operate your business or make decisions on your behalf.

Hamia is not a licensed financial, legal, or immigration adviser. Nothing generated by a Hamia product constitutes professional advice, and you remain responsible for the accuracy of the information your own business provides and for how you run your business.

3. Your Account

A single Hamia account works across every Hamia product you use. To access certain features, you must create an account. You are responsible for:

• Providing accurate and truthful information when registering
• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently.

4. Subscriptions and Payments

Hamia's products are paid subscriptions. There is no free trial before payment, payment is required to activate a subscription. Every plan includes a one time, 7 day grace period after your first paid period ends, described in full on our pricing page.

Subscription fees are billed in advance, monthly or annually depending on the billing cycle you choose. All payments are non-refundable, except where required by applicable law. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing period.

5. Acceptable Use

Your use of Hamia's products is also governed by our Usage Policy, which describes what is and is not acceptable in more detail, including prohibited use and how violations are handled. In short, you agree not to use Hamia to:

• Provide false or misleading information
• Attempt to gain unauthorised access to our systems or other users' accounts
• Scrape, copy, or reproduce our content without permission
• Use our products for any unlawful purpose
• Interfere with or disrupt the operation of our products for other businesses

6. AI Generated Content

Hamia Agent and Hamia Manager generate responses using the knowledge base, rules, and boundaries your business configures, enforced through the pipeline described in our product documentation, not left to chance in a single prompt. Hamia does not guarantee that AI generated responses will always be accurate, complete, or appropriate for every situation.

You are responsible for reviewing and configuring your own business's knowledge base, rules, and escalation settings, and for the consequences of any AI generated response sent on your business's behalf.

7. Intellectual Property

All content on Hamia's products (including text, design, and software) is owned by or licensed to Hamia Ltd. You may not reproduce, distribute, or create derivative works from it without our express written permission. Your own business content, uploaded to your knowledge base, remains yours, see our Privacy Policy's Data Ownership and Control section for more detail.

8. Third-Party Services

Hamia's products connect to third-party services to function, including messaging and social platforms you choose to connect and payment processors. Your use of those third-party services is also governed by their own terms. See our Privacy Policy for how information is shared with them.

9. Disclaimer of Warranties

Hamia's products are provided on an “as is” and “as available” basis. We do not warrant that our products will be uninterrupted, error free, or completely secure. We make no guarantees about the accuracy, completeness, or suitability of AI generated responses for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Hamia Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products, including but not limited to loss of data, loss of income, or a customer conversation handled by an AI generated response.

Our total liability to you for any claim arising from your use of our products shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may cancel your subscription and close your account at any time from your account settings. We may suspend or terminate your access to Hamia's products if you violate these terms or our Usage Policy, or where required by law. Sections of these terms that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, will continue to apply.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria, Hamia Ltd's current registered jurisdiction. Any disputes arising from these terms or your use of our products shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or by displaying a notice on hamia.io. Your continued use of Hamia after any changes means you accept the updated terms.
